form during the 45 calendar days in order to permit consideration of any
comments submitted by CSEA.
Article 27
Distribution of Overtime
§27.1 (a) Available overtime for non-supervisory work shall be
distributed on the basis of overtime rosters by title or by groups of titles by
work location equitably among qualified employees who normally do such
work under the supervisor responsible for assigning the overtime involved.
Original placement on overtime rosters shall be based on seniority as
defined in the Seniority Article of this Agreement.
(b) Overtime shall first be offered to employees in seniority order from
the overtime roster. Refusal of voluntary overtime shall be treated as
overtime worked for the purpose of placement on the voluntary overtime
roster. If no employee elects to accept the overtime assignment, it shall be
assigned on a mandatory basis to employees in reverse order of seniority.
Any employee who is passed over on the mandatory overtime roster as a
result of his or her not being on duty when mandatory overtime is
distributed, shall retain his or her position on the mandatory overtime
roster. Nothing contained herein shall limit the development of local or
agency labor/management procedures regarding the distribution of
overtime.
(c) At CSEA’s request, procedures for the establishment, publication,
maintenance and operation of overtime rosters, shall be developed at
agency or local level labor/management meetings. Local procedures should
provide notice to employees of the possibility of a mandatory overtime
assignment. When it is known, notice of such overtime shall be given to
employees at the beginning of their regular shift.
(d) Claims involving alleged failures to comply with assignment of
overtime shall be subject to the Grievance Procedure.
§27.2 Nothing contained in this Article shall form a basis for any claim
for wages or overtime premiums for hours not worked.
§27.3 A record of actual overtime hours worked by an employee will be
maintained and made available for reasonable inspection by the appropriate
CSEA representative.
§27.4 For the purpose of earning and payment of overtime compensation,
