needs of the department or agency, and has the ability to perform duties and

        responsibilities satisfactorily. The  requirement to prove qualification shall

        rest with the employee.
           (e) Each such operating unit shall establish and maintain procedures for

        notifying appropriate local representatives of CSEA that appointments have
        been made to non-competitive class positions for which announcements of

        vacancies have been distributed or posted as prescribed herein.
           (f) Prior to appointment of an individual from outside State  service to a

        permanent labor class vacancy, an employee with a temporary appointment
        in  the  same  labor  class  title  at  the  specific  work  location/operating unit

        where the permanent vacancy exists, shall, if continued as an employee in
        that title, be appointed to the permanent vacancy. If there is more than one

        temporary appointee  at the  work location  where  the  vacancy  exists,
        selection of the permanent appointee shall be at the State’s discretion.

           §45.2 Competitive Class Positions
           (a) Each  appointing  authority  shall  be  responsible  for  establishing and

        maintaining  procedures  to  insure  that  Civil  Service  examination
        announcements are distributed or posted so that qualified employees under

        his or her jurisdiction have a reasonable opportunity to  learn of pending
        examinations.

           (b) Each  operating  unit  as  defined  above  shall  establish  and  maintain
        procedures for distributing or posting  announcements of  permanent and

        temporary vacancies in competitive class positions at that operating unit at
        least 10 calendar days prior to the date they are to be filled. Announcements

        of such vacancies shall contain the title of the position or positions to be

        filled, minimum qualifications required for appointment, and the number
        and work location of  the vacancies.
           (c) When such vacancies are announced as provided herein, employees

        who wish to be considered for transfer or reassignment  to such vacancies

        shall  be allowed to  file appropriate notice  thereof with  the appointing
        authority; provided, however, that such notice must be filed within 15 days
        following announcement of the vacancy.

           (d) All employees canvassed for appointment from a  promotion eligible

        list who indicate a willingness to accept such  appointment if offered shall
        be notified in writing when an appointment is made from such eligible list

        or  when  a  determination  is  made  not  to  fill  the  vacancy  or  vacancies
