Department of Transportation during the period of November 1 to April 15
inclusive, and the requirements placed on employees in the Office of
Transportation Systems Maintenance, the parties agree that the following
provisions shall apply only to winter maintenance activity of that Office:
(a) Standby, On-Call
The provisions of Article 47 shall apply should the Department determine
that standby, on-call shall be utilized (except as impacted by elements of
the call-out response plan described below). In the event that standby, on-
call is to be established, the appropriate Department officials shall meet and
confer with CSEA prior to and/ or during the season as appropriate, at a
mutually agreed to level(s) on the following issues:
• Rationale for standby, on-call use;
• Designation of employees to be placed on standby, on-call;
• Specific periods of standby, on-call;
• Method of assignment to standby, on-call status;
• Release from standby, on-call status;
• Employee responsibility;
• Anticipated manner of use of standby, on-call;
• Employee leave as it relates to standby status; and
• Payment policy.
In order to avoid confusion over implementation, the Department will
ensure that conflicts over implementation and administration issues will be
addressed expeditiously.
(b) Distribution of Overtime
The provisions of Article 27 shall apply except in the following situations:
(1) When employees are to be assigned to shifts, the overtime rosters
shall be established by shift at each work location.
(2) The overtime rosters established for each shift shall be comprised of
all employees (including certain regional crew and drill crew personnel)
who are assigned primarily to winter snow and ice control.
(3) Regional crew and drill crew personnel who are primarily assigned to
non-snow and ice control work and are assigned to a shift as needed for
snow and ice control, shall be placed at the bottom of the overtime roster
for that shift.
(4) Available overtime shall first be distributed among employees who
